Electronic Diversity Visa Lottery - Eligibility and Process
Eligibility
The U.S. Department of State (DOS) is primarily responsible for administering the Electronic Diversity Visa Lottery and for regulating the Diversity Visa process. The DV Program is available to 55,000 natives of “low-admission foreign states” who meet certain education and experience requirements.
The DV applicant must have a high school diploma or its equivalent, or must possess two (2) years of work experience in an occupation requiring at least two (2) years of training or experience within the last five (5) years preceding application for DV. Derivative beneficiaries, such as spouse, don’t have to satisfy this requirement.
Process
DV applicants must register online through the DOS’ Electronic Diversity Visa portal during the open registration period (typically beginning of October through end of November). While only one application per applicant is allowed, each family member who meets the eligibility criteria may submit a separate registration each year.
The winners are randomly selected from the entries received during the registration period. The winning entrants will be sent a notification letter by the Kentucky Consular Center via regular mail. The notification letter includes a case number, foreign state chargeability, consular post designation and detailed visa application instructions.
In order to obtain Lawful Permanent Status, a principal beneficiary and accompanying derivative family members (spouse and unmarried children under 21) must apply for an Immigrant Visa through Consular Processing. Alternatively, DV beneficiaries in the U.S. may apply for Adjustment of Status. A visa must be available for the individual’s regional rank order case number in both instances (see DOS Visa Bulletin - DV Priority Dates). All DV-based applicants must obtain approval of their immigrant visa application or application to adjust status before September 30th of the year in which the application was made. Failure to obtain an approval by that date will result in applicants losing their eligibility to obtain permanent residence based on the DV program.
